Title: Where have the "independence" naysayers gone? Post by BucStopsHere on 07/20/07 at 12:24pm Looks to me like Andy very clearly gave independence and cart blanche to the investigation team. Where have those that knew the "real truth" gone? Was there an unpublished side letter that recants the publicly released one where the BOE superceded Super Andy? http://www.hscin.org/EngagementLetter.pdf |

I may have misread your post, or may simply not understand it, but you seem to be implying that the letter states that Mr. Pointer is totally independent. Last night, however he made it clear that he worked for the BOE: Judge Pointer said that all the interviewees have been cooperative. He made clear that he and his firm represent the Board of Education and not the individuals being interviewed. He said some of them were apprehensive about being interviewed. No one has made any attempt to limit the investigation. This does not suggest independence, unless I have missed something. Title: Re: Where have the "independence" naysayers gone? Post by hunterSF on 07/20/07 at 3:39pm SuperdolFan is correct, I was at the meeting last night and Sam Pointer said to the whole crowd that his client is the BOE. Outside the meeting I asked him to repeat that for me. I asked, "The board of education, as a whole, is your client...and no one else. Right?" He said, "Yes, that is correct." Now if I were Carol Martin or Richard Bishop or anyone else for that matter, except for members of the BOE, I would not want to talk with the BOE's lawyer W/out having a lawyer of my own present. If I were in a legal dispute with another person I wouldn't be very smart to talk to the other person's lawyer...I would want my lawyer present...or really...I would not want to say anything to a lawyer who WAS NOT MY LAWYER...unless it was in a deposition or in court WITH MY LAWYER PRESENT TO LOOK OUT FOR MY RIGHTS. You know, I OBJECT..LEADING...I OBJECT, IRRELEVANT...I OBJECT..I WAS NAPPING AND JUST WOKE UP. For what it's worth...and I am not trying to make a big deal about this, but I asked Mr. Pointer if former federal Judge Robert Propst and Coach Propst are related. Pointer, who went to law school with Robert Propst and was a "colleague on the bench" with Judge Propst, confirmed thett Judge Propst annd Coach Propst are cousins once removed...just FYI |

Title: Re: Where have the "independence" naysayers gone? Post by riverteacher on 07/23/07 at 1:10am Hello Hunter, You are right on about the attorney-client privilege situation. The BOE can choose what details, if any, to make public. However, if the investigators find evidence of illegal (as opposed to improper, unethical, immoral, low-life alley-catting) activity involving the schools, then the BOE jeopardizes itself and its members if that knowledge is suppressed. I wouldn't worry too much about cousins twice removed, I think around here money is thicker than blood. |
